The Punjab and Haryana High Court has asked the Directors-General of Police (DGPs) of Punjab, Haryana, and Chandigarh to create a Standard Operating Procedure (SOP). This SOP will guide police on handling sensitive cases and prevent false FIRs.

Court Warns Against Abuse of Legal Process

Justice Alok Jain expressed concern over citizens filing false FIRs, putting innocent people at risk.

He said, “This petition shows a worrying trend where people misuse the legal system, endangering others’ safety and liberty.”

SOP to Ensure Proper Investigation

The Court directed that Class-I gazetted officers conduct a preliminary inquiry in sensitive cases before taking action.

Justice Jain emphasized, “Citizens have the right to protect their fundamental rights, but they must tell the truth and avoid filing false complaints.”

Case Details

The order came from a case involving serious allegations by the petitioner’s youngest sister, who claimed misconduct over 22 days.

The investigation showed:

• Police registered the FIR and arrested the petitioner.

• The complainant later withdrew her statement.

• After eight months, she reached a compromise and married one of the accused.

• The petitioner’s lawyer argued that the FIR was false and fabricated.

Justice Jain highlighted the need for clear guidelines to stop misuse of the FIR system and ensure fair investigations.
